Emma is an intellectual property lawyer with experience in both litigation and commercial matters. She gained broad litigation experience training at Barlow Lyde & Gilbert where she qualified into their Commercial Litigation Department in September 2004.
Emma regularly advises on legal issues relating to the creation, exploitation and enforcement of UK and Community intellectual property rights. Specifically, Emma has extensive experience of advising clients in relation to patents, trade marks, design rights and passing off.
She has experience of working on multi-jurisdictional disputes with lawyers throughout Europe and the US. She has particular experience of patent and trade mark litigation. Her experience in patent litigation has primarily involved cases with a high level of scientific/medical content.
The issues upon which she has advised have covered many industry sectors and involved a wide range of technologies. Emma has advised in relation to intellectual property infringements on the Internet and has experience of both the ICANN and Nominet domain name dispute resolution procedures.
She also advises on commercial and transactional matters. A significant part of her practice consists of advising clients in connection with the development and exploitation of their intellectual property rights. She has advised on co-existence agreements, distribution agreements and licensing. She has been involved in substantial due diligence exercises, the most recent of which involved an acquisition of an extensive patent portfolio which was the subject of a complicated licensing regime.
Emma joined Marks & Clerk Solicitors in June 2004. She is a member of the Law Society. She speaks French and enjoys skiing, cooking, riding and art.
